Refund policy
Cancellation & Refund Policy
Layaway is a way of paying for goods over time. You do not receive the Products until the Total Purchase Price has been paid in full, so this policy explains what happens if you stop a plan before then, rather than how to return a delivered item.
Cancelling your plan
You may cancel your layaway agreement at any time before the Products are dispatched, for any reason. You are never obligated to complete your purchase.
If applicable law gives you a cancellation right that cannot be waived or limited, that law applies.
To cancel, use the cancel option in your account or email contact@laybyusa.com.
Cancellation fee
If you cancel — or if we end your agreement after the 2-day missed-payment notice process, or because you move delivery outside the Eligible States — we may retain, where the law permits, a cancellation fee equal to 15% of the Total Purchase Price, up to a maximum of $150.
The cancellation fee will never exceed the amount you have paid and is deducted only from payments already received — you will never owe us any additional amount because of a cancellation fee. If the law of your state requires a lower fee, prohibits the fee, or requires a greater refund, the fee is reduced or removed to that extent.
The fee recovers only part of the real costs of setting up, administering, servicing and closing a layaway plan. Those costs often exceed $150; we cap the fee anyway.
Worked example: on a $600 Total Purchase Price the cancellation fee is $90, so if the agreement ends after you have paid $250, your refund is $160. If you have paid less than the fee — say $50 — the fee is limited to that $50 and you owe nothing further.
Missed and failed payments
A missed or failed payment is not a default, does not create a debt you owe us, and is never sent to collections or reported to a credit bureau. If a payment fails we may retry it only where your authorization, the law and the card-network rules allow, contact you, pause further attempts, or invite you to choose a revised plan.
There is no fee for a failed payment. We do not charge an administration, dishonour or late fee when a scheduled payment does not go through. Your bank or card issuer may separately charge its own fees for failed payments.
If payments are repeatedly missed and you do not take a pause or a revised plan, we give you at least 2 days' written notice and the opportunity to resume, change the plan, or cancel. If we then end your agreement as abandoned, the cancellation fee may apply — never more than you have paid — and the rest is refunded. We stop attempting scheduled payments; we never charge a monthly fee for holding your balance.
When no cancellation fee applies at all
Some cancellations carry no cancellation fee whatsoever:
- Your first payment went through but we could not complete your order — full refund.
- We cannot reasonably supply your product, or cannot provide a substitute you approve — full refund.
- We offer a substitute product and you decline it, or do not approve it in writing — full refund. We never ship a substitute you have not approved; silence is not acceptance.
- A material pricing or product-description error prevents fulfilment — full refund.
- We cannot dispatch within 14 calendar days of your final payment and you choose to cancel — full refund.
- We cancel your agreement for any other reason that is not caused by you, including because we stop trading — full refund.
See the Shipping and Delivery policy for the substitute and geographic cases.
How refunds are paid
We issue refunds within 7 business days after the refund amount is determined, to the card you paid with where reasonably practicable. Your bank or card issuer may take extra time to post it. If your card is closed, expired, or cannot accept the refund, contact us and we will arrange another lawful method after verifying your identity.
If we owe you a refund but cannot return it, we will try to contact you, and the balance remains yours to claim — contact us at any time to reclaim it. Your money is never silently forfeited. If it stays unclaimed for the period set by your state's unclaimed-property law, we report and pay it to that state as that law requires, and you can then claim it from the state.
Your consumer rights
Nothing in this policy limits any right you have under applicable consumer-protection laws.
